1. Introduction and Acceptance

Welcome to Gigxomi.com (“Platform”). By accessing our website, creating an account, or using our services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use the Platform.

2. Nature of the Platform

2.1 Marketplace Role: Gigxomi.com operates strictly as an online marketplace connecting independent Clients (Buyers) with independent Service Providers (Freelancers/Editors). 2.2 No Employment Relationship: Gigxomi.com is not the employer, agent, or partner of any Service Provider. Service Providers act as independent contractors. The Platform does not guarantee the quality, safety, or legality of the services provided.

3. Service Fees and Commission

3.1 Commission Structure: In consideration for the use of the marketplace, marketing, and payment processing, Gigxomi.com charges a Commission Fee of 30% on the gross value of every project. 3.2 Deduction: This 30% fee is deducted automatically from the Service Provider’s earnings at the time of payout. (Example: If a project cost is ₹1,000, the Service Provider receives ₹700, and Gigxomi.com retains ₹300). 3.3 Client Payments: Clients generally pay the listed price or agreed quote. No additional fees are charged to the Client unless explicitly stated at checkout.

4. STRICT NON-CIRCUMVENTION & ANTI-FRAUD POLICY

4.1 Prohibition on Off-Platform Transactions: Users strictly agree to conduct all negotiations, communications, and financial transactions exclusively through Gigxomi.com. The exchange of personal contact information—including but not limited to phone numbers, email addresses, WhatsApp, Telegram, or social media handles—prior to a confirmed and paid contract is strictly prohibited.

4.2 Consequences for Service Providers (Freelancers): If a Service Provider is found soliciting off-platform payments or sharing contact details to bypass Platform fees:

  • Immediate Termination: The Service Provider’s account will be permanently suspended immediately.
  • Legal Action: Gigxomi reserves the right to pursue full legal action against the Service Provider for breach of contract and damages.
  • Forfeiture of Funds: Any funds currently held in the Service Provider’s wallet or pending payouts will be frozen and forfeited as a penalty for the breach.

4.3 Consequences for Clients (Buyers): If a Client is found attempting to pay a Service Provider outside of the Platform or soliciting contact details to bypass Platform fees:

  • Blacklisting: The Client’s account will be permanently blacklisted.
  • No Refunds: The Client expressly waives their right to any refunds. Any funds currently deposited in Escrow or held in the Client’s account will be forfeited as a penalty.
  • Liability: The Platform assumes no liability for any loss incurred by the Client resulting from off-platform transactions.

5. Intellectual Property and Portfolio Usage

5.1 Ownership: Unless otherwise agreed in writing, the Client is granted full intellectual property rights to the delivered work only upon full payment. 5.2 Portfolio Disclaimer: Gigxomi.com is not responsible or liable if a Service Provider displays, publishes, or showcases work done for a Client in their personal portfolio, social media, or marketing materials. 5.3 Client Responsibility: If the Client requires confidentiality (White-Labeling/NDA), it is the Client’s sole responsibility to execute a Non-Disclosure Agreement directly with the Service Provider before the project commences. The Platform is not a party to such agreements.

6. User Conduct

Users agree not to:

  • Post false, misleading, or fraudulent content.
  • Use the Platform for money laundering or illegal activities.
  • Harass, abuse, or discriminate against other users.

7. Cancellations and Refunds

7.1 Dispute Resolution: In the event of a dispute, the Gigxomi.com support team acts as the final arbitrator. 7.2 Refund Eligibility: Refunds to Clients are only issued if the Service Provider fails to deliver the work or the work violates the project scope significantly. 7.3 No Refund on Terms Violation: As stated in Section 4.3, no refunds are processed if the Client is banned for violating Non-Circumvention rules.

8. Limitation of Liability

To the fullest extent permitted by law, Gigxomi.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the services;
  • Any conduct or content of any third party on the services;
  • Any unauthorized portfolio usage by Service Providers.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of Dewas, Madhya Pradesh.
